Terms of Use

1. Agreement to these Terms

These Terms of Use (“Terms”) govern your access to hexapong.rhynockgames.com, the browser-playable version of Hexapong, and Hexapong applications distributed through Apple's App Store, Google Play, and Steam, together with related accounts, cloud saves, leaderboards, support, purchases, and newsletter features (together, the “Services”). By accessing or using the Services, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the Services.

“Hexapong,” “we,” “us,” and “our” refer to Rhynock Games, based in Missouri, United States of America. Some platform versions are not yet released. A platform-specific term applies only when that version or feature is available.

2. Platform terms

Your use of a platform-distributed version is also subject to the rules and agreements of that platform. If a mandatory platform term conflicts with these Terms, the mandatory platform term controls only to the extent of that conflict.

• Apple: unless Rhynock Games submits a custom end-user license agreement through App Store Connect, Apple's Standard Licensed Application End User License Agreement applies to an Apple-distributed version. Apple's Media Services Terms and App Store rules may also apply.
• Google Play: Google Play's terms, policies, billing rules, and family requirements apply to the Android version distributed through Google Play.
• Steam: the Steam Subscriber Agreement, Steam Online Conduct rules, and other applicable Steam terms apply to the Steam version and Steam account features.

3. Eligibility and children

Hexapong gameplay is intended to be suitable for players of any age. You must be legally able to agree to these Terms. If you are below the age of legal majority where you live, a parent or legal guardian must review and agree to them for you.

Hexapong does not ask players to provide their age or date of birth. Parents and legal guardians are encouraged to supervise minors' use of account, public leaderboard, and purchase features. Apple, Google, Steam, and other platform accounts remain subject to their respective platform rules and parental controls.

4. Guest play and accounts

You may play supported portions of Hexapong as a guest. Guest progress may be stored only on your device and can be lost if you clear storage, uninstall the app, switch devices or browsers, use private browsing, or the storage becomes unavailable.

Account features may require sign-in with a supported Google, Apple, Steam, or other platform account. You are responsible for keeping that provider account secure, for activity under your Hexapong account, and for providing accurate information. You may not sell, transfer, share, or impersonate another person's account.

If you move guest progress into an account, Hexapong may ask whether to combine or keep that progress separate. Cloud synchronization reduces the risk of loss but is not a backup guarantee. Cross-platform progress is available only for the modes, data, and entitlements that Rhynock Games expressly identifies as cross-platform. Contact us promptly if you believe your account has been compromised.

5. Pilot names and public content

A pilot name and leaderboard result are public content. You grant Rhynock Games a worldwide, non-exclusive, royalty-free license to host, reproduce, display, transmit, and format that content only as reasonably needed to operate, promote, secure, and moderate the Services.

You may not choose a pilot name or submit content that:

• is hateful, harassing, threatening, sexually explicit, obscene, or unlawfully discriminatory;
• contains personal information, impersonates another person, or falsely suggests affiliation;
• infringes intellectual property, privacy, publicity, or other rights;
• advertises, spams, solicits, or directs players to unsafe material; or
• is otherwise unlawful or reasonably likely to harm players or the integrity of Hexapong.

Automated filters may block some names, but no filter catches everything. We may reject, change, hide, or remove a pilot name or result, and may require you to choose another name, when we reasonably believe it violates these Terms or creates a safety, legal, or integrity concern.

Signed-in players may privately report or block another public pilot. A personal block affects only the blocking account's view. Reports may be reviewed for safety, fair play, and enforcement. A player may submit additional context or appeal a moderation action at RhynockGames@gmail.com.

6. License to use Hexapong

Subject to these Terms and applicable platform terms, Rhynock Games grants you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Services for personal, non-commercial entertainment. This license does not transfer ownership of Hexapong, its software, audiovisual material, music, artwork, branding, or other content.

7. Fair play and acceptable use

You agree not to:

• cheat, automate play, falsify scores, exploit bugs, manipulate client or network data, or interfere with leaderboards;
• bypass security, rate limits, access controls, App Check, anti-abuse measures, purchase validation, or account restrictions;
• reverse engineer, decompile, scrape, copy, redistribute, or create derivative works except where law expressly permits;
• introduce malware, overload systems, probe for vulnerabilities, or disrupt another player's use;
• use Hexapong or its content for commercial exploitation without written permission; or
• use the Services in violation of law, platform rules, or another person's rights.

We may investigate suspicious activity, decline or quarantine a score, correct or reset rankings, remove data, restrict features, or suspend an account when reasonably necessary to protect players and game integrity.

8. One-time purchases and paid features

If Hexapong offers a paid item or feature:

• the purchase screen will identify the item, price, currency, included benefits, and other material terms before confirmation;
• digital purchases in an Apple app will use Apple In-App Purchase, purchases in a Google Play app will use Google Play Billing, and purchases in the Steam version will use the Steam Wallet and Steam microtransaction system where required;
• the applicable storefront processes payment and controls its payment, tax, cancellation, chargeback, and refund procedures;
• eligible non-consumable purchases will include a restore method where the platform requires one;
• virtual items and entitlements are licensed, not sold, have no cash value, and may not be transferred or exchanged unless Rhynock Games expressly allows it;
• an entitlement is cross-platform only if its purchase description expressly says so;
• a verified Apple lifetime Hexapong Pro transaction is bound to the first active Hexapong account that claims it and cannot be transferred while that account remains active;
• after the owning Hexapong account is deleted, a new account may reclaim that Apple purchase only after server verification of the same current transaction;
• an entitlement may be withheld or revoked if a purchase is invalidated, refunded, charged back, obtained through fraud, or otherwise not successfully completed; and
• nothing in these Terms limits refund, cancellation, or consumer rights that cannot legally be waived.

9. Availability, updates, and changes

Hexapong is an evolving game. We may add, modify, rebalance, remove, or temporarily disable modes, modifiers, progression, scores, features, content, integrations, or technical requirements. We may perform maintenance or discontinue part or all of a Service. We will try to provide reasonable notice when a change materially affects paid access, but uninterrupted or error-free availability is not guaranteed. Platform updates may be required to continue using online features.

10. Third-party services and links

The Services rely on or link to services provided by Google, Apple, Firebase, Cloudflare, Buttondown, Valve/Steam, storefronts, and other third parties. Your use of those services may be governed by separate terms and privacy policies. Rhynock Games is not responsible for a third party's independent service, content, security, or availability.

11. Ownership and feedback

Rhynock Games and its licensors retain all rights, title, and interest in Hexapong and its content, excluding the limited public content you provide. Hexapong names, logos, visual designs, game systems, and related marks may not be used without permission.

If you voluntarily submit feedback or ideas, you grant Rhynock Games a perpetual, worldwide, irrevocable, royalty-free right to use, adapt, and incorporate them without restriction or compensation. Do not submit confidential information as feedback.

12. Suspension, termination, and account deletion

You may stop using the Services at any time. You can start secure web account deletion at hexapong.rhynockgames.com/delete-account. Where a released app allows account creation, it will provide an in-app account-deletion option as required by the platform. You may alternatively request deletion of a Hexapong account by emailing RhynockGames@gmail.com from the address associated with the account. We may ask you to verify ownership. Deletion may permanently remove your profile, cloud progress, and leaderboard entries, but does not delete your separate Apple, Google, or Steam account.

Deleting the owning Hexapong account releases its active Apple lifetime Pro binding. Rhynock Games retains a one-way transaction fingerprint for fraud prevention and entitlement recovery; it is not the receipt, signed transaction, Apple ID, payment information, or a reusable purchase credential. Limited moderation evidence may also remain as reasonably needed for safety, appeals, fraud prevention, legal compliance, or disputes.

We may suspend or terminate access, remove content, revoke improperly obtained entitlements, or preserve evidence when we reasonably believe you violated these Terms, created risk or legal exposure, threatened game integrity, or when required by law. Where reasonable, we will provide notice and an opportunity to appeal.

Sections that by their nature should survive termination—including ownership, disclaimers, liability limits, platform terms, purchase obligations, and dispute provisions—will survive.

13. Disclaimers

To the maximum extent permitted by law, the Services are provided “as is” and “as available.” Rhynock Games disclaims implied warranties of merchantability, fitness for a particular purpose, non-infringement, and quiet enjoyment. We do not warrant that the Services will be uninterrupted, secure, error-free, compatible with every device, or that progress, rankings, entitlements, or data will never be lost or changed. Some jurisdictions do not allow certain disclaimers, so some of this section may not apply to you.

14. Limitation of liability

To the maximum extent permitted by law, Rhynock Games and its contributors, service providers, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or business interruption arising from the Services. Rhynock Games' total liability for claims relating to the Services will not exceed the greater of the amount you paid Rhynock Games for the Services during the twelve months before the claim or US $25.

These limits do not apply where prohibited by law or to liability that cannot legally be limited, including any non-waivable consumer rights. Some jurisdictions do not allow certain liability limits, so some of this section may not apply to you.

15. Governing law and disputes

These Terms are governed by applicable federal law of the United States of America and the laws of the State of Missouri, without overriding mandatory consumer protections available where you live. Before filing a formal claim, you and Rhynock Games agree to make a good-faith effort to resolve the issue by contacting the other party and allowing a reasonable time to respond. This section does not prevent either party from seeking urgent relief or using a small-claims or consumer-resolution process where available.

16. Changes to these Terms

We may update these Terms as Hexapong changes. The revised version will be posted with a new effective date. If a change materially reduces your rights, we will provide additional notice where required. Continuing to use the Services after revised Terms become effective means you accept them; if you do not accept them, stop using the Services.

17. General terms

If a provision of these Terms is unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; Rhynock Games may assign them as part of a merger, acquisition, reorganization, or transfer of the Services. These Terms, the Privacy Policy, and applicable platform agreements are the entire agreement for the Services unless a separate written agreement expressly applies.
